Some 63 prominent citizens of the country in a joint statement urged the government to take steps to stop the harassment of the workers of the Banshkhali coal-fired power plant in connection with the incident in which six workers were killed in police firing on April 17 this year. 

The statement was signed by advocate Sultana Kamal, Dr Zafrullah Chowdhury, Khushi Kabir, Dr Hossain Zilllur Rahman, Badiul Alam Majumder, Prof Anu Mohammad, Syed Iftekharuzzaman, Syeda Rezwana Hasan and Dr Shahidul Alam, among others, alleging that the police, instead of conducting impartial and independent inquiry to the incident, arrested Engineer Shahnewaj Chowdhury from Gandamara area of Banshkhali on May 27 for his post on Facebook. 

As a result, it said, nobody will dare to speak against any corruption and irregularities of the coal-fired power project. 

Through this Facebook post, Shahnewaj expressed his own opinion and urged the youths to play a role against the illegal activities and corruption which should not be deemed as a move to create anarchy or a stability, said the statement. 

It mentioned a High Court bench on May 4 has ordered the authorities concerned to pay condensation of Tk 5 lakh to each of the victims and provide security and protection to the workers, families and locals of the Banshkhali power plant and not to harass them anyway.

Some 63 prominent citizens of the country in a joint statement have urged the government to take steps to stop the harassment of the workers of Banshkhali coal-fired power plant. 

Five workers were killed and over 30 were injured as police opened fire on demonstrators demanding payment of dues as well as breaks for prayer/iftar during Ramadan. Two more workers succumbed to their injuries while undergoing treatment. 

The statement was signed by advocate Sultana Kamal, Dr Zafrullah Chowdhury, Khushi Kabir, Dr Hossain Zilllur Rahman, Badiul Alam Majumder, Prof Anu Mohammad, Syed Iftekharuzzaman, Syeda Rezwana Hasan and Dr Shahidul Alam, among others.

The statement mentioned that a High Court bench on May 4 ordered S Alam Group to pay compensation of Tk5 lakh to each of the victims, and provide security and protection to the workers, families and locals of the Banshkhali power plant and not to harass them anyway. 

After the April 17 incident, Dr Zafrullah Chowdhury and several others visited Banshkhali and spoke to the families of the deceased. He demanded Tk50 lakh as compensation for the families of the workers. 

Police and district administration, later, formed two separate probe bodies to investigate the matter. 

Two cases were filed on April 18. Sub-Inspector Rashed of Banshkhali police filed a case accusing 2,500 unidentified people on charges of attacking law enforcers. 

Faruk Ahmed, chief coordinator of the power plant, a joint venture involving S Alam Group, lodged another case against 22 named and 1,040 unnamed people for setting vehicles on fire during the incident. 

On April 26, State Minister for Labour and Employment Begum Monnujan Sufian announced Tk2 lakh as compensation. Besides, the junior minister also announced to provide Tk50,000 as treatment cost to each of the victims who sustained injuries in the incident.

চট্টগ্রামের বাঁশখালীতে কয়লাবিদ্যুৎকেন্দ্র নিয়ে সামাজিক যোগাযোগমাধ্যমে পোস্ট দেওয়ার অভিযোগে গ্রেপ্তার প্রকৌশলীর মুক্তি দাবি করেছেন দেশের ৬৩ জন নাগরিক। আজ শনিবার গণমাধ্যমে দেওয়া এক বিবৃতিতে তাঁরা এই প্রকৌশলীর বিরুদ্ধে করা মামলা প্রত্যাহারের দাবি জানান। 

স্থানীয় পুলিশ আজ প্রথম আলোকে জানায়, কয়লাবিদ্যুৎকেন্দ্র নিয়ে ফেসবুকে পোস্ট দেওয়ায় শুক্রবার রাতে বাঁশখালী উপজেলার গন্ডামারা ইউনিয়নের ৯ নম্বর ওয়ার্ডের মো. শাহনেওয়াজ চৌধুরী (৩৫) নামের এক ব্যক্তিকে গ্রেপ্তার করে পুলিশ। গন্ডামারায় নির্মাণাধীন কয়লাবিদ্যুৎকেন্দ্র নিয়ে পোস্ট করলেও তিনি কী লিখেছিলেন, তা পুলিশ জানায়নি। 

বিবৃতিতে বলা হয়, ‘এই পোস্টের মাধ্যমে শাহনেওয়াজ চৌধুরী প্রকল্পের বিষয়ে নিজস্ব মতামত ব্যক্ত করেছেন। যুবসমাজকে লেখনীর মাধ্যমে অন্যায়ের বিরুদ্ধে ভূমিকা নেওয়ার আহ্বান জানিয়েছেন। এটাকে কোনোভাবেই আক্রমণাত্মক, মিথ্যা বা অস্থিরতা ও বিশৃঙ্খলা সৃষ্টির চেষ্টা মনে হওয়ার যুক্তিসংগত কোনো কারণ নেই। আমরা মনে করি, জোরপূর্বক ভিন্নমত দমনের উদ্দেশ্যে ডিজিটাল নিরাপত্তা আইনের বিতর্কিত ধারাগুলোর অধীনে কয়লাবিদ্যুৎ প্রকল্পের কর্মকর্তার দায়ের করা ভিত্তিহীন ও বিদ্বেষমূলক মামলায় বাঁশখালী থানার পুলিশ তাঁকে গ্রেপ্তার করেছে।’ 

বিবৃতিতে বলা হয়, ‘বাঁশখালীর বিতর্কিত কয়লাবিদ্যুৎকেন্দ্রের স্বার্থ রক্ষা করতে ২০১৬, ২০১৭ ও সর্বশেষ ২০২১-এর ১৭ এপ্রিলে পুলিশের গুলিবর্ষণের ঘটনায় অন্তত ১২ জন নিরীহ শ্রমিক ও গ্রামবাসী নিহত হয়েছেন এবং গুরুতর আহত হয়েছেন অর্ধশতাধিক মানুষ। নিহত ১২ জনের ৬ জনই গণ্ডামারার অধিবাসী। যেখানে সব মহল থেকে এসব গুলিবর্ষণের ঘটনার নিরপেক্ষ তদন্ত ও দোষীদের শাস্তি প্রদান করার দাবি উঠেছে, সেখানে এ বিষয়ে ব্যবস্থা গ্রহণ না করে সরকার বরং ভুক্তভোগীসহ সবার কথা বলার অধিকারের সংকোচন করছে নানাভাবে।’ 

বিবৃতিদাতারা বলেন, ‘আমরা অত্যন্ত উদ্বেগের সঙ্গে লক্ষ করছি যে বাঁশখালীতে পুলিশের গুলিতে গ্রামবাসী-শ্রমিকদের নিহত-আহত হওয়ার ঘটনায় কোনো নিরপেক্ষ তদন্ত ও কার্যকর আইনি পদক্ষেপ গ্রহণ হয়নি বরং ৩,৫৬২ জন নিরস্ত্র শ্রমিক ও এলাকাবাসীকে আসামি করে প্রকল্প উদ্যোক্তা ও পুলিশ মামলা দায়ের করেছে, যা অব্যাহত হয়রানির সুযোগ সৃষ্টি করছে।’ 

বিবৃতিদাতারা ডিজিটাল নিরাপত্তা আইনকে ‘নিপীড়নমূলক ও সংবিধানবিরোধী’ হিসেবে চিহ্নিত করে এটি বাতিলের দাবি জানান।

Murder, assault, arrest and torture must be stopped in Banshkhali

At least 12 innocent workers and villagers were killed and more than 50 were seriously injured in police firing on 2016, 2017 and last April 17, 2021 to protect the vested interests of the controversial Banshkhali coal-fired power plant. Six among the 12 murdered were residents of Gandamara. While there is a demand from everywhere for an unbiased investigation of the shooting and for the perpetrators to be held for justice, instead of taking any action for that, the government is restricting the right of all, including the victims, to speak out. For posting on Facebook regarding the coal-fired power plant the Banshkhali police have arrested engineer Shahnewaz Chowdhury from Gandamara on the night of May 27, 2021 (Thursday). Consequently, no one would dare to speak out in future against any irregularities, corruption or mismanagement related to the project. 

On May 27, 2021, Faruk Ahmed, the Chief Coordinator of Banshkhali Power Plant, filed the case under sections 25, 29 and 31 of the Digital Security Act, alleging "offensive and false disclosure, creating animosity, instability and chaos". Case No. 48/173. According to the statement of the case, Engineer Shahnawaz Ahmed, a resident of Gandamara, wrote in a Facebook post on May 26, 2021 at 3:00 pm: “Breaking News: The people of Banshkhali thought that the environmentally destructive coal power plant which already have killed 12 lives, would have made the Gandamara Union floating in the tide of development. But in reality, Gandamara is drowning in the tidal surge. The youth of Banshkhali should play a leading role against injustice and for development through fearless writing.”

Through this post, Shahnawaz Ahmed has expressed his opinion on the project and called on the youth to take a stand against injustice through writing which is in no way an aggressive, false or unreasonable attempt to create unrest and chaos. There are enough reasons to believe that the Banshkhali police have arrested him on a baseless and contemptible case filed by a coal power project officer under the controversial sections of the Digital Security Act for the purpose of forcibly suppressing the dissent. 

It is to be mentioned that on May 4, 2021, the High Court ordered to pay compensation of 5 lakh BDT to each of the victim’s family and to provide security and safety to the workers of Banshkhali Power Station, their families and locals and not to harass them in any way. The High Court order has been directly violated through this case and arrest. 

We are seriously concerned that no impartial investigation and effective legal action has been taken in the incident of killing and injuring of villagers and workers by the police firing in Banshkhali, rather, the project owners and the police have filed cases accusing 3,562 unarmed workers and locals, creating opportunities for continued harassment. Besides, two cases filed in favor of the victims in 2016 have been quashed by the district judge's court due to the hostility of the administration. 

Moreover, the report submitted by the Investigation Committee of the Police Department on May 19, 2021, does not mention the mismanagement and illegal actions of the project owners for the shooting and does not recommend identifying and punishing the police personnel responsible for that, rather linguistic distance, threats to the Chinese workers, mismanagement of the contractors, etc. have been dragged out in a highly irrelevant manner in order to divert incidents such as shooting and killing towards a different direction. We reject such investigation report and demand immediate cessation of all attacks, killings, arrests and torture using state forces for the benefit of the Banshkhali coal power project and its owners and demand exemplary legal action against all those who are responsible. 

We fully support the rights of the people of Banshkhali to lives, livelihoods, property and environment and demand that, 
  1. Respecting the order of the Hon'ble Court, the case filed in the name of Engineer Shahnewaz Ahmed should be immediately withdrawn and he should be released; 
  2. Repeal oppressive and unconstitutional Digital Security Act 2018; 
  3. Police members responsible for the April 17 shooting must be identified and brought to justice; 
  4. A case must be filed on behalf of the victims in Banshkhali; 
  5. The environmentally destructive Banshkhali coal-fired power plant must be scrapped and appropriate action must be taken against the mismanagement and illegal actions of the sponsor companies; 
  6. Adequate compensation and rehabilitation of the dead and injured should be arranged.

বাঁশখালীর বিতর্কিত কয়লা-বিদ্যুৎকেন্দ্রের স্বার্থ রক্ষা করতে ২০১৬, ২০১৭ ও সর্বশেষ ২০২১-এর ১৭ এপ্রিলে পুলিশের গুলিবর্ষণের ঘটনায় অন্তত ১২ জন নিরীহ শ্রমিক ও গ্রামবাসী নিহত হয়েছেন, এবং গুরুতর আহত হয়েছেন অর্ধশতাধিক। নিহত ১২ জনের ৬ জনই গণ্ডামারার অধিবাসী। যেখানে সকল মহল থেকে এসব গুলিবর্ষণের ঘটনার নিরপেক্ষ তদন্ত ও দোষীদের শাস্তি প্রদান করার দাবি উঠেছে সেখানে এ বিষয়ে ব্যবস্থা গ্রহণ না করে সরকার বরং ভুক্তভোগীসহ সকলের কথা বলার অধিকারের সংকোচন করছে নানাভাবে। সর্বশেষ গত ২৭ মে ২০২১ (বৃহস্পতিবার) রাতে কয়লা-বিদ্যুৎকেন্দ্রের বিষয়ে ফেসবুকে পোস্ট দেয়ার অভিযোগে বাঁশখালী পুলিশ গণ্ডামারা থেকে প্রকৌশলী শাহনেওয়াজ চৌধুরীকে গ্রেপ্তার করেছে। এর ফলে প্রকল্প সংশ্লিষ্ট কোন অনিয়ম, দুর্নীতি কিংবা অব্যবস্থাপনার বিরুদ্ধে কেউ ভবিষ্যতে কথা বলার সাহস পাবে না। 

গত ২৭ মে ২০২১, বাঁশখালী বিদ্যুৎকেন্দ্রের চিফ কোঅর্ডিনেটর ফারুক আহমেদ ডিজিটাল নিরাপত্তা আইনের ২৫, ২৯ ও ৩১ ধারার আওতায় ”আক্রমণাত্মক মিথ্যা তথ্য প্রকাশ করে বিদ্বেষ, অস্থিরতা ও বিশৃঙ্খলা সৃষ্টির” মিথ্যা অভিযোগে মামলাটি দায়ের করেন। মামলা নম্বর ৪৭/১৭৩। মামলার এজাহার অনুসারে, গত ২৬ মে ২০২১ বিকাল ৩:০০টায় গণ্ডামারার অধিবাসী প্রকৌশলী শাহনেওয়াজ আহমেদ ফেসবুক পোস্টে লেখেন : “ব্রেকিং নিউজ : টুয়েল্ভ মার্ডারের (১২ খুনের) পরিবেশ বিধ্বংসী কয়লা বিদ্যুৎকেন্দ্রের কারণে বাঁশখালীর মানুষ মনে করেছিল, গন্ডামারা ইউনিয়ন উন্নয়নের জোয়ারে ভাসছে। আজ দেশের মানুষ প্রকৃতপক্ষে দেখতে পাচ্ছে, গণ্ডামারাবাসী জোয়ারের পানিতে হাবুডুবু খাচ্ছে। বাঁশখালীর তরুণ ও যুবসমাজকে সাহসী লেখনীর মাধ্যমে অন্যায়ের বিরুদ্ধে এবং উন্নয়নের পক্ষে অগ্রণী ভূমিকা রাখতে হবে নির্ভয়ে।” 

এই পোস্টের মাধ্যমে শাহনেওয়াজ আহমেদ প্রকল্পের বিষয়ে নিজস্ব মতামত ব্যক্ত করেছেন এবং যুবসমাজকে লেখনির মাধ্যমে অন্যায়ের বিরুদ্ধে ভূমিকা নেয়ার আহ্বান জানিয়েছেন যা কোনভাবেই আক্রমণাত্মক, মিথ্যা বা অস্থিরতা ও বিশৃঙ্খলা সৃষ্টির চেষ্টা মনে হওয়ার যুক্তিসংগত কোন কারণ নেই। আমরা মনে করি যে, জোরপূর্বক ভিন্নমত দমনের উদ্দেশ্যে ডিজিটাল নিরাপত্তা আইনের বিতর্কিত ধারাগুলোর অধীনে কয়লাবিদ্যুৎ প্রকল্পের কর্মকর্তার দায়ের করা ভিত্তিহীন ও বিদ্বেষমূলক মামলায় বাঁশখালী থানার পুলিশ তাঁকে গ্রেপ্তার করেছে। 

উল্লেখ্য যে, গত ৪ মে ২০২১ মহামান্য হাইকোর্ট নিহতদের প্রত্যেককে আপাতত ৫ লাখ টাকা ক্ষতিপূরণ দেয়ার পাশাপাশি বাঁশখালী বিদ্যুৎকেন্দ্রে কর্মরত শ্রমিক, শ্রমিকদের পরিবার ও এলাকাবাসীর নিরাপত্তা ও সুরক্ষা দেয়ার এবং তাঁদেরকে কোন প্রকার হয়রানি না করার আদেশ দেন। এই মামলা ও গ্রেপ্তারের মধ্য দিয়ে হাইকোর্টের আদেশ সরাসরি লঙ্ঘন করা হয়েছে। 

আমরা অত্যন্ত উদ্বেগের সাথে লক্ষ্য করছি যে, বাঁশখালীতে পুলিশের গুলিতে গ্রামবাসী-শ্রমিকদের নিহত-আহত হবার ঘটনায় কোনো নিরপেক্ষ তদন্ত ও কার্যকরী আইনি পদক্ষেপ গ্রহণ হয়নি বরং ৩,৫৬২ জন নিরস্ত্র শ্রমিক ও এলাকাবাসীকে আসামী করে প্রকল্প উদ্যোক্তা ও পুলিশ মামলা দায়ের করেছে যা অব্যাহত হয়রানির সুযোগ সৃষ্টি করছে। এছাড়া প্রশাসনের বৈরীতার কারণে ২০১৬ সালে নিহতদের পক্ষে দায়েরকৃত দুটি মামলা জেলা জজ আদালতে খারিজ হয়ে গেছে। 

উপরন্তু, পুলিশ সদর দপ্তরের গঠিত তদন্ত কমিটির ১৯ মে ২০২১ দাখিলকৃত প্রতিবেদনে গুলি করে হত্যার জন্য প্রকল্প উদ্যোক্তার অব্যবস্থাপনা ও বেআইনি কার্যক্রমের বিষয়ে কিছু উল্লেখ বা দায়ী পুলিশ সদস্যদের শনাক্ত ও শাস্তির সুপারিশ না করে অযথা গুলিবর্ষণ ও হত্যাকাণ্ডের মত ঘটনা ভিন্নখাতে প্রবাহিত করার উদ্দেশ্যে ভাষাগত দূরত্ব, চীনা শ্রমিকদের হুমকি প্রদান, ঠিকাদারদের অব্যবস্থাপনা ইত্যাদি বিষয় চরম অপ্রাসঙ্গিকভাবে টেনে আনা হয়েছে। আমরা এ ধরনের দায়সারা তদন্ত প্রতিবেদন প্রত্যাখ্যান করছি এবং বাঁশখালীতে কয়লাবিদ্যুৎ প্রকল্প এবং এর উদ্যোক্তাদের স্বার্থরক্ষায় রাষ্ট্রীয় বাহিনী ব্যবহার করে সকল প্রকার হামলা, হত্যা, গ্রেপ্তার ও নির্যাতন অবিলম্বে বন্ধে এবং এর জন্য দায়ী সকলের বিরুদ্ধে যথাযথ আইনি প্রক্রিয়া দৃষ্টান্তমূলক শাস্তি দাবি জানাচ্ছি। 

বাঁশখালীর জনগণের জীবন-জীবিকা-সম্পদ ও পরিবেশের অধিকারের প্রতি পূর্ণ সমর্থন জানিয়ে আমরা দাবি জানাচ্ছি যে, 
  1. মহামান্য আদালতের আদেশের প্রতি শ্রদ্ধা জানিয়ে অবিলম্বে প্রকৌশলী শাহনেওয়াজ আহমেদের নামে দায়েরকৃত মামলা প্রত্যাহার ও তাঁকে মুক্তি দিতে হবে; 
  2. নিপীড়নমূলক ও সংবিধান-বিরোধী ডিজিটাল নিরাপত্তা আইন বাতিল করতে হবে; 
  3. ১৭ এপ্রিল গুলিবর্ষণের জন্য দায়ী পুলিশ সদস্যদের চিহ্নিত করে বিচারের মুখোমুখি করতে হবে; 
  4. বাঁশখালীতে নিহতদের পক্ষে মামলা দায়ের করতে হবে। 
  5. পরিবেশ-বিধ্বংসী বাঁশখালী কয়লা-বিদ্যুৎকেন্দ্র বাতিল করতে হবে এবং বিনিয়োগকারী কোম্পানির অব্যবস্থাপনা ও বেআইনি কার্যক্রমের বিরুদ্ধে যথাযথ ব্যবস্থা গ্রহণ করতে হবে। 
  6. নিহত ও আহতদের পর্যাপ্ত ক্ষতিপূরণ ও পুনর্বাসনের ব্যবস্থা করতে হবে।

Call to drop cases against workers in deadly Bangladesh protest

Several NGOs and human rights organizations have called for the immediate withdrawal of cases filed against Bangladeshi workers over a protest that led to police shooting dead five people.

Workers at the S. Alam-owned SS Power Plant in Banshkhali in Chittagong district were holding a demonstration on April 17 over working conditions and overdue salaries when police opened fire on them, killing five and injuring at least 30.

Police and S. Alam Group have filed two cases against the protesters accusing them of attacking police officers and setting fire to vehicles.

The Bangladesh Working Group on External Debt, NGO Forum on ADB, Asian People’s Movement on Debt and Development, Netherlands-based Re-course and Urgewald held a virtual press conference on April 19.

The groups called for strict legal measures against the sponsor and financers of the under-construction power plant and the police for being responsible for killing five workers.

At the press conference, Abdul Gani, a welder at the plant, gave a first-hand account of the incident.

“A syndicate takes 5,000 taka (US$59) in advance for the worker’s job, 2,000 taka for clothing and 10 percent of the monthly salary of each worker. Before the lockdown, we worked for 12 hours without any overtime. The salary was 18,000 taka for two shifts. After lockdown the work hours came down to 10 hours, but no overtime," he said.

“As we don’t have any trade unions, we demanded an eight-hour day in the month of Ramadan, a one-hour break on Fridays for Jumma prayers and an overtime payment. We also demanded advanced salary during Eid.”

Ryayan Hasan from NGO Forum on ADB termed the killings an absolute violation of human and constitutional rights.

“We demand that all financers of the project including the Bank of China and China Exim are held accountable for their failure to safeguard the workers,” he said.
